1. Scope

These Terms of Service apply to all orders placed through the online store Gorixan, operated by:

In these terms, "we", "us" and "our" refer to tigraM UG (haftungsbeschränkt), and "you" refers to the customer. By using our website or placing an order, you agree to these terms. Any different terms of the customer do not apply unless we have expressly agreed to them in writing.
 

2. Use of the Website

You may use our website only for lawful purposes. By placing an order, you confirm that you are at least 18 years old or are acting with the consent of a parent or legal guardian.
 

When creating a customer account, please provide accurate and complete information and keep your login details confidential. You are responsible for all activity that takes place under your account.

3. Conclusion of Contract

The product presentations in our online store are not a legally binding offer, but an invitation for you to place an order.
 

By clicking the "Buy now" button (or a button with similar wording) at the end of the checkout process, you submit a binding offer to purchase the products in your shopping cart. You will then receive an automatic email confirming that we have received your order. This confirmation does not yet constitute acceptance of your offer.
 

The contract is concluded when we send you a separate email confirming the shipment of your order, or when we deliver the goods.

The language of the contract is German or English. We save the text of the contract and send you the order details by email. You can also view your past orders in your customer account if you have created one.
 

4. Prices and Payment

All prices shown in our store are final prices in euros and include the statutory German VAT. Shipping costs are shown separately at checkout.
 

The payment methods available to you are displayed during checkout. Payment is due at the time the order is placed.
 

5. Delivery

We deliver exclusively within Germany. We offer free standard shipping with an estimated delivery time of 4 to 5 business days and insured express shipping for €2.95 with an estimated delivery time of 3 to 5 business days. Further details can be found in our Shipping Policy.
 

If a product is not available after your order, we will inform you immediately and refund any payment already made.
 

6. Retention of Title

The goods remain our property until full payment has been received.
 

7. Right of Withdrawal

As a consumer, you have a statutory right of withdrawal of 14 days. Full details, including the model withdrawal form, can be found on our Returns & Refunds page.
 

8. Warranty

The statutory warranty rights apply. If a product you receive is defective, please contact us at info@gorixan.com.
 

9. Liability

We are liable without limitation for damages resulting from injury to life, body or health, for damages caused intentionally or through gross negligence, and in cases of mandatory liability under the German Product Liability Act.
 

For slight negligence, we are only liable for the breach of essential contractual obligations, meaning obligations whose fulfillment makes the proper performance of the contract possible in the first place and on which you may regularly rely. In such cases, our liability is limited to the foreseeable damage typical for this type of contract.
 

10. Accuracy of Information

We take great care to present our products accurately. Minor differences in color may occur due to screen settings. Despite our efforts, our website may occasionally contain errors in product descriptions, prices or availability. We reserve the right to correct such errors.
 

11. Intellectual Property

All content on this website, including texts, images, graphics and logos, is the property of tigraM UG (haftungsbeschränkt) or its licensors and is protected by copyright. You may not copy, distribute or otherwise use this content without our prior written consent.
 

12. Prohibited Use

You may not use our website to violate any laws, infringe the rights of others, transmit harmful code, collect data from other users, send spam or interfere with the security or operation of the website. We may block access to the website if these rules are violated.
 

13. Reviews and Feedback

If you send us reviews, comments or suggestions, you agree that we may use and publish them in connection with our store. Your content must not be unlawful, offensive or infringe the rights of third parties.
 

14. Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. If you have a complaint, please contact us directly at info@gorixan.com.
 

15. Applicable Law

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of the protection of mandatory consumer protection provisions.
 

16. Severability

If any provision of these terms is or becomes invalid, the validity of the remaining provisions shall not be affected.
 

17. Changes to These Terms

We may update these terms from time to time. The version valid at the time of your order applies to that order.
